Terms of Use

1. Acceptance of Terms

These Terms of Use ("Terms") govern your use of the SnapJournal mobile application ("App") operated by Tenere LLC ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

2. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's consent to use the App.

3. Your Account

You sign in to the App using Apple Sign-In or Google Sign-In. You are responsible for maintaining the security of your device and account credentials. You agree to notify us immediately if you suspect unauthorized use of your account.

When you log out of the App, all local data on your device is permanently deleted. This action cannot be undone.

4. Your Content

You retain ownership of all photos and images you upload to the App ("User Content"). By uploading User Content, you grant us a limited, non-exclusive license to process, store, and transmit your content solely for the purpose of providing the App's services — including sending images to third-party AI providers for schedule extraction.

You are solely responsible for the content you upload. You represent that you have the right to upload and share any content you provide to the App.

5. AI-Powered Features

The App uses Google Gemini, a third-party AI service, to analyze photos of your handwritten planner pages and extract schedule entries. By using this feature, you acknowledge and agree that:

• Your uploaded images are sent to Google for AI processing
• AI-generated results may contain errors — extracted dates, times, and event details are not guaranteed to be accurate
• You are responsible for reviewing and confirming all extracted events before they are added to your calendar
• Any content visible in your photos (including personal notes) will be processed by the AI provider

We are not responsible for any errors, omissions, or inaccuracies in AI-generated content.

6. Calendar Integration

The App can create, update, and delete events in your connected calendars (Apple Calendar, Google Calendar, and Outlook Calendar). By connecting a calendar, you authorize the App to modify calendar events on your behalf.

We are not responsible for missed, incorrect, or duplicate calendar events, whether caused by AI extraction errors, sync failures, or any other reason. You should always verify important events independently.

7. Acceptable Use

You agree not to:

• Upload content that is illegal, harmful, abusive, or violates the rights of others
• Use the App to process images that do not belong to you without permission
• Attempt to reverse-engineer, decompile, or extract the source code of the App
• Interfere with or disrupt the App's servers or infrastructure
• Use the App in any way that violates applicable laws or regulations
• Circumvent any rate limits or security measures

We reserve the right to suspend or terminate your account if you violate these Terms.

8. Third-Party Services

The App relies on third-party services including Google, Apple, Microsoft, Supabase, Cloudflare, Sentry, Canny, and Upstash. These services are subject to their own terms and conditions. We are not responsible for the availability, accuracy, or conduct of any third-party service.

9. Intellectual Property

The App, including its design, code, branding, and trademarks, is the property of Tenere LLC. You may not copy, modify, distribute, or create derivative works from the App without our prior written consent. This does not affect your ownership of User Content as described in Section 4.

10. Service Availability

We strive to keep the App available and functioning, but we do not guarantee uninterrupted or error-free operation. The App may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control (including third-party service outages). We are not liable for any loss resulting from service interruptions.

11. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT AI-GENERATED SCHEDULE EXTRACTIONS WILL BE ACCURATE, COMPLETE, OR ERROR-FREE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TENERE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, MISSED CALENDAR EVENTS, SCHEDULING ERRORS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, REGARDLESS OF THE CAUSE OF ACTION OR THEORY OF LIABILITY.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $50 USD, WHICHEVER IS GREATER.

13. Termination

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. You may stop using the App at any time by logging out and deleting it from your device.

Upon termination, your right to use the App ceases immediately. Sections 4, 5, 6, 9, 11, 12, and 14 survive termination.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or your use of the App shall be resolved in accordance with applicable law.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of changes by updating the effective date at the top of this page. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms. We encourage you to review this page periodically.
